On what grounds can you contest a Will in Australia?
The contents of a Will can be contested in Australia by law if there is good reason. Some of the grounds for contest include:
- The deceased did not have the mental capacity needed to understand their Will at the time it was made.
- There is a later Will of the deceased.
- The Will is not validly made in accordance with the Wills Act.
- It is challenged by family members of the deceased on the basis that it has not made adequate provision for a member of the deceased’s family pursuant to the Inheritance Family Provision Act 1972.

How do you handle an inheritance dispute?
Most inheritance disputes (or disputed Wills and estates) can be resolved in an informal settlement conference or pre-action meeting where the parties attend a meeting in person with one of our solicitors to try and resolve a dispute before it proceeds to litigation.
Settlement conferences and mediation are a good option to reduce legal costs associated with an inheritance dispute.
In our experience mediation is successful at resolving disputes at least 80% of the time.
